The laws about being under the influence of controlled substances in Nevada are included under Nevada Revised Statute (NRS) 453.411. The State recognizes two lawful exceptions to the crime of being under the influence of drugs.
It is not a crime when:
- The drug was used with a lawfully issued prescription, or
- The drug was administered at a rehabilitation clinic or hospital established or licensed by the state
It is also not a crime to be put under the influence of a controlled substance without your knowledge. It is only a violation of the law to knowingly be under the influence of drugs.
The penalties for being under the influence of drugs may change depending on the circumstances and the type of drug. The List of Scheduled Narcotics shows what drugs are considered “controlled substances” and are illegal in Nevada.
