Many drug users – and even witnesses of drug abuse – immediately hesitate at the sight or experience of a drug overdose. They know medical attention is required but stumble in making the necessary emergency call for fear of being criminally prosecuted in the aftermath. Nevada is making great strides in implementing the Good Samaritan Drug Overdose Act, an act designed to drop the number of deaths in drug abusers by eliminating the fear of prosecution in those who feel they may overdose or those who happen to witness one in progress.

Conditions of the Good Samaritan Drug Overdose Act

The Act allows those who witness a drug overdose, or even those who are experiencing one, to call 911 emergency services without the charge or prosecution of possession of drugs or drug paraphernalia. While many before were afraid to call 911 out of certainty that their drug overdose is a clear indication of illegal activity, the Act prioritizes saving the abuser’s life and forgives drug possession. Still, the Act does no forgive all illegal activity occurring at the time of the overdose or in the neighboring vicinity.

There are still cases in which other illegal activities occur simultaneously with the drug use in question, and these activities, aside from drug possession, may still warrant an arrest, even if you are the one that called. For example, if the individual or an associate of the individual overdosing is in possession of stolen property, that crime may still be pursued because it is not the exact same crime as the drug possession. Yet, while it is impossible to speculate specific circumstances and decisions made by law enforcement at the time, the responders to the incident may prioritize caring for the affected individual and also take into consideration your selfless efforts to save a life.
